These General Conditions regulate the electronic purchase that the interested buyer (hereinafter, the “user”) makes through the website www.homeandliving.es (hereinafter, the “portal”), and will be incorporated into his purchase contract (hereinafter, the “contract”) when he clicks the “Complete Purchase” button at the end of the purchase process, and he is obliged from that moment to comply with the stipulations therein.

The portal is owned by Panorama Servicios Integrales SL., with registered office at Calle Mar Adriático N.5 San Fernando de Henares, Madrid, with CIF number B88031646 , which is registered in the Mercantile Registry of Madrid, Volume 1573 book 1001 folio 54, sheet 7005 current M-77611, and is in force.

Panorama Servicios Integrales SL may modify these General Terms and Conditions of Purchase at any time. Modifications will not affect purchases made prior to the approval of said modifications, which will be governed in all cases by the General Terms and Conditions in effect at the time of those purchases. It is the user's responsibility to be aware of the General Terms and Conditions of Purchase in effect at the start of the purchase process.

By accepting the conditions, the user declares that they are of legal age and have sufficient legal capacity to be bound by these General Purchase Conditions.

Applicable regulations

This electronic contract is governed by Spanish law, specifically Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE). The electronic contract will not be archived by a third party, and the language for its conclusion is Spanish. These General Terms and Conditions of Sale may be saved and reproduced at any time by the user making a purchase using their internet browser's options and must be read and accepted before finalizing the purchase.

Register as a user

To purchase Panorama Servicios Integrales SL products online, you do not need to register as a user on the website (www.homeandliving.es). You can make a purchase without registering. Registration is free and can be done via the "Register" tab on the website. Upon completion of the registration process, you will receive an email confirming that it has been successfully completed.

Purchase process

The Purchase Process consists of the following steps:

Once the purchase is confirmed, the customer may not modify or cancel the order except in the cases provided for by law or in these General Conditions.

Price, taxes and shipping costs

All prices shown on the website are in euros and include all applicable taxes and fees within Spain. However, purchases from other countries may be subject to additional taxes and/or duties. Panorama Servicios Integrales SL will withhold payment from the bank details provided by the user on the website for the final amount of the order.

Shipping costs will be detailed at the end of the checkout process, and you will need to choose your preferred shipping method. These shipping costs are the sole responsibility of the customer.

Before accepting the price by clicking "Complete Purchase," you will be able to see the full final price of your order, broken down, where applicable, by the amount of any increases or discounts applied, as well as shipping costs, taxes, duties, or other additional services.

Product prices may vary at any time depending on Panorama Servicios Integrales SL's pricing policy. Purchased products will be billed at the price in effect at the time of purchase.

Pay

Users may pay for the price of the products purchased by any of the following means:

  1. a. By means of debit or credit cards issued by Spanish financial institutions of the following classes.
  2. b. Via PayPal, directed to the PayPal platform, where you make your payment securely through your personal PayPal account, without sharing your bank details with Panorama Servicios Integrales SL.

The user's order payment occurs in real time through the Virtual POS once it has been verified that the data provided is correct.

Panorama Servicios Integrales SL guarantees that it will treat with complete security and confidentiality the personal data obtained through the registration form filled out by the user.

Bill

Panorama Servicios Integrales SL will send the purchase confirmation by email to the address provided by the user. Additionally, Panorama Servicios Integrales SL will deliver the order invoice to the user upon delivery of the order to the address provided, if requested during the purchase process by selecting the option provided for this purpose.

The user may request their invoice at any time by sending an email to [email protected] , indicating the order number for which the corresponding invoice is requested.

Delivery

Orders will be shipped within the following territories: Spain (Peninsula and Balearic Islands).

Home delivery will be made from Monday to Friday. The user can specify any details regarding the shipment, as well as the delivery method, according to the options provided by Panorama Servicios Integrales SL at any given time.

The user will acquire ownership of the products in question once the full agreed price has been paid.

In the event that delivery is not possible, Panorama Servicios Integrales SL is entitled to cancel the contract due to impossibility of performance and without prejudice to any claims that Panorama Servicios Integrales SL may initiate in the event of fraud or negligence on the part of the user.

Panorama Servicios Integrales SL will not be responsible for the condition in which the products are delivered to the user in case of impossibility of delivering the order within the agreed period due to causes attributable to the user.

The user assumes all risk regarding the products upon delivery, regardless of when they acquire ownership. Therefore, Panorama Servicios Integrales SL will not be liable for any theft, robbery, deterioration, damage, or loss of the products that occurs after the user has been given possession.

Responsibility for delivery

Panorama Servicios Integrales SL does not guarantee the permanent availability of the products, and is exonerated from any type of liability provided that it is not caused by a willful breach on the part of Panorama Servicios Integrales SL, or that it derives from errors in the unavailability of the service of the telematics networks of data transfer beyond its control.

Furthermore, Panorama Servicios Integrales SL will be released from its delivery obligations as set out in Clause 9 above, and declines all responsibility in this regard, in the following cases:

  1. 1. Total or partial non-payment by the user.
  2. 2. Omission or inaccuracy of the information that, in accordance with Clauses 3, 5, 6 and 7, must be provided by the user in the purchase order at the time of placing the order.

Defective product or damaged during transport

If the product is damaged during transport, it is essential that the user report this by telephone on the same day of receiving the products and note it on the carrier's delivery slip. Panorama Servicios Integrales SL will cover the shipping costs for both the delivery and return of the product.

If the user wishes to return the merchandise with a transport company other than the one proposed by Panorama Servicios Integrales SL and the transport company selected by the user offers higher rates, the user will assume the difference in the transport cost.

Before opening any product, the user must verify that the packaging matches the order (model, color, size, finish, etc.), and file an immediate claim if there is any discrepancy. If the user detects any discrepancy before opening the product, Panorama Servicios Integrales SL requests that the seal and packaging not be broken.

Warranty

All our products are guaranteed nationwide against manufacturing defects for 2 years, except for those products where another period is indicated.

The warranty is expressly excluded in the following cases:

  1. a. This warranty does not cover damage caused by transport, accidents, misuse, or other factors not due to normal use of the product by the customer after delivery. It only covers transport damage that occurs before the goods are received.
  2. b. Transporting the product without the original packaging.
  3. c. Burns, cuts, scrapes, creases, marks, scratches or other damage caused by animals or by improper use of the product.
  4. d. Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, lacquers or other hairdressing products...), treatment with cleaning products not indicated for the specific upholstery of the guaranteed product.
  5. e. Color deterioration due to exposure of the product to sunlight or other heat sources.
  6. f. Indirect damages and losses of any kind.
  7. g. Damages, personal and/or material, caused as a result of the user's non-compliance with the rules and instructions given by Panorama Servicios Integrales SL for the installation, use and maintenance of the product.

    Force Majeure

    Panorama Servicios Integrales SL will not be liable for the total or partial breach of the obligations arising from this contract or for the delay in the performance thereof if such breach is due to a circumstance of force majeure, including general, territorial or sectoral strikes, flood, fire, etc.

    Nullity or voidability and applicable law and jurisdiction

    If any of the clauses of this contract should be found to be null, voidable, illegal or unlawful, in such case, and in the broadest interpretative sense permitted by law (a) such declaration shall not invalidate the rest of the contract, which shall remain in force and effect, and (b) the null or voidable clause or clauses shall be replaced or adjusted preferentially to being annulled.

    The foregoing conditions shall be governed by and construed in accordance with Spanish law in all matters not expressly provided for herein. Panorama Servicios Integrales SL and the user expressly agree to waive any other jurisdiction and to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts of the city of Girona.
